This post clarifies one narrow point regarding prior discussion of trash collection governance at Poudre Overlook HOA.
Upon re-review of the Declaration, the authority to select the trash collection provider is assigned to the Association, acting through its Board of Directors. The governing documents do not require a vote of the Members on vendor selection.
At the same time, the Declaration does not forbid the Board from seeking member input, conducting a nonbinding vote, or surveying homeowners prior to making a decision that affects the entire community, as has been done in the past on other matters.
This clarification resolves only the question of vendor-selection authority. It does not alter or resolve the broader governance and process issues previously raised, including:
- how costs are characterized and imposed,
- whether services beyond “trash collection” (such as yard waste) are regulated,
- meeting notice, agenda approval, and documentation,
- and transparency around Board actions taken to structure the January 14 Special Members Meeting.
This clarification is provided to ensure accuracy in ongoing discussion and to keep attention focused on the remaining unresolved process and governance questions.
