Another week, another Secret Executive Session Board Meeting to be held at 3pm on a week day, and yet again in a private home. While technically, someone could ask to be there at the beginning, since the agenda is 100% Executive Session, you’d be asked to leave almost immediately.
Once again, since the “dog incident” is reportedly finished and closed as a legal matter, the only thing left is responsiveness to the Document Requests. The 3/28/24 request received partial response, but the Board is now accruing statutory penalties for not producing the requested Proxies from the 12/5/23 and 3/19/24 elections.
And, a new document request was submitted on 4/16/24, requesting the invoices for the “verbal agreement” with Ms. Hutchinson, as well as the invoices from VF-Law in 2021-22.
The first document request over the proxies demanded a $300 payment to see less than 30 pieces of paper, and is likely to be found unreasonable if Small Claims Court is pursued. A payment of $22.57 was sent, which was to have the documents printed and sent via UPS. I had claimed that they should be sent digitally.
And, the Secretary made an allusion to redacting the information on the Proxies, which is so minimal, it would essentially be responding to the request with copies of the blank form. There is no information on that form that requires redaction, as the owner names and addresses are already required to be produced upon request (per CCIOA), and it does not contain private information like email addresses or phone numbers, which might be considered private. Therefore, there’s no “work” to redact them for which there might be a reason for some sort of charge.
Meanwhile, on the 4/16 request, these documents are known to already be digital, so they should be sent without any charge whatsoever. It will be interesting to see what reasons they come with to avoid just a simple production without drama.
